Terms of Service

These Terms of Service ("Terms") govern your use of OpenSail. By creating an account or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.
1. What OpenSail is — and is not
OpenSail is a marine weather routing and forecast visualization platform. It assists sailors with passage planning by combining publicly available weather models (including NOAA GFS and Copernicus Marine services) with a routing engine that considers vessel performance and comfort. OpenSail is a planning tool.
OpenSail is not a navigation system, not a chart, not a safety system, and not a substitute for professional judgment. Weather forecasts are imperfect. Routing engines, including ours, make assumptions about your vessel, your polar performance, and the state of the ocean that may differ from reality. Conditions at sea can change rapidly and without warning. You must not rely on OpenSail as your sole or primary source of weather, navigation, or safety information. Always consult official charts, tide and current predictions, local notices to mariners, and national marine forecasts appropriate to your area before and during any voyage.
The skipper is responsible for the safety of the vessel, crew, and passengers. Use of OpenSail does not transfer that responsibility to us.
2. Account and eligibility
- You must be at least 16 years old to create an account.
- You are responsible for the security of your account credentials and for activity under your account.
- One person or organization per account; do not share credentials.
- You must provide accurate account information and keep it current.
3. Acceptable use
You agree not to:
- Scrape, mirror, or redistribute our data or service output except through documented API endpoints under your own authenticated key.
- Attempt to overload, disrupt, or probe the service for vulnerabilities without our written permission.
- Use the service in violation of any applicable law, including sanctions and export-control laws.
- Impersonate another person, organization, or vessel.
- Use the service to support activities where reliance on a single routing tool could endanger life without independent verification.
4. Paid plans, billing, and cancellation
- Paid plans are billed in advance, monthly or annually, by Stripe on our behalf. Plan pricing and features are shown at opensail.io/pricing.
- You may cancel at any time. Your plan remains active through the end of the current billing period.
- You may pause an active subscription (for voyages on the hard or similar circumstances). Pausing suspends further charges; resuming restores the plan without loss of history.
- Refunds are at our discretion; we generally do not refund partial periods but will refund if we materially fail to deliver the service.
- We may change prices or plan contents with at least 30 days' notice by email, effective on your next renewal.
5. Developer API
If you create a developer API key, you agree to: (a) keep the key secret; (b) respect published rate limits; (c) attribute OpenSail as the source when you present our data to others; (d) not use the key to build a functionally equivalent competing routing product; and (e) revoke keys for ex-employees promptly. We may revoke keys or suspend access if these conditions are not met.
6. Intellectual property
The OpenSail software, design, and marketing materials are copyrighted and trademarked by us. Weather data is sourced from public providers whose licenses we respect and attribute. Routes, vessels, and voyages you create remain yours; you grant us a limited license to store and process them to provide the service. If you make a voyage public, you grant us a further license to display it to the audience you choose to share it with.
7. Warranties — or lack thereof
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. WE DO NOT WARRANT THE ACCURACY OR CURRENCY OF ANY WEATHER DATA OR COMPUTED ROUTE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENSAIL AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) USD $100.
Nothing in this section limits liability that cannot be limited as a matter of law (for example, gross negligence or willful misconduct in some jurisdictions).
9. Indemnity
You agree to indemnify and hold OpenSail harmless from claims by third parties arising from your breach of these Terms, your violation of law, or your misuse of the service — except to the extent we are directly at fault.
10. Termination
You may terminate your account at any time from the account page. We may suspend or terminate accounts that violate these Terms or that are unused for more than 24 months. Upon termination, we will delete your personal data as described in our Privacy Policy.
11. Export control and sanctions
You confirm that you are not located in a country subject to a U.S. Government embargo, and are not listed on any U.S. Government restricted-parties list. You will not export or re-export the service in violation of applicable law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be submitted to confidential binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Wilmington, Delaware, unless you are a consumer in a jurisdiction that prohibits mandatory arbitration, in which case the dispute may be brought in a local court of competent jurisdiction. You and we each waive the right to a jury trial and to participate in a class action, to the extent permitted by law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email and posted here at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and OpenSail on the subject matter. If a provision is held unenforceable, the remainder remains in effect. We do not waive a right by not enforcing it in a given instance. You may not assign these Terms without our consent; we may assign them to a successor in interest in connection with a corporate transaction.
